1. Introduction
Welcome to Fratres. These Terms of Use ("Terms") govern your access to and use of the Fratres platform, including the Fratres website available at fratres.net, any country-specific Fratres websites, mobile applications, tools, features, and related services (collectively, the "Platform").
Fratres operates as a global employment and recruitment platform, connecting job seekers and candidates with employers and recruiters across 61+ countries worldwide.
Please read these Terms carefully before using the Platform. By accessing or using Fratres in any way, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, you must not access or use the Platform.
2. Acceptance of Terms
Your use of the Fratres Platform constitutes your binding agreement to these Terms. These Terms apply to all users of the Platform, including candidates, job seekers, employers, recruiters, visitors, and any other individuals or entities who access or use any part of the Platform.
If you are using the Platform on behalf of an organisation, business, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and references to "you" shall include both you personally and that entity.
We reserve the right to update or revise these Terms at any time. We will notify users of material changes where reasonably practicable. Your continued use of the Platform following the publication of updated Terms constitutes your acceptance of those changes.
3. Eligibility and User Requirements
To use the Fratres Platform, you must:
- Be of legal age to form a binding contract in your jurisdiction (in most cases, at least 18 years of age or the applicable age of majority in your country);
- Have the legal capacity to enter into these Terms;
- Not be prohibited by applicable law from accessing or using the Platform; and
- Comply with all applicable local, national, and international laws and regulations.
By using the Platform, you represent and warrant that you meet all of the above eligibility requirements. If you do not meet these requirements, you must not access or use the Platform.
Fratres does not knowingly permit use of the Platform by minors below the applicable age of majority. If you become aware that a minor has registered on the Platform without appropriate consent, please contact us immediately.
4. Definitions
For the purposes of these Terms, the following definitions apply:
- "Fratres" or "we" or "us" or "our" refers to the Fratres platform and its operating entity.
- "Platform" means the Fratres website (fratres.net), any country-specific Fratres websites, applications, tools, and associated services.
- "User" means any individual or entity that accesses or uses the Platform in any capacity.
- "Candidate" or "Job Seeker" means a user who accesses the Platform to search for employment, create a candidate profile, upload a CV or resume, or apply for job listings.
- "Employer" means a user or organisation that accesses the Platform to post job listings, search for candidates, or engage in recruitment activities.
- "Recruiter" means an individual or agency using the Platform on behalf of employers or independently to facilitate recruitment.
- "Job Listing" means any employment opportunity, vacancy, role, position, or related posting published on the Platform by an employer or recruiter.
- "User Content" means any information, data, text, profiles, CVs, job listings, communications, or other material submitted by users to the Platform.
- "Services" means all features, tools, functions, and services provided through the Platform.
- "Account" means a registered user account created on the Platform.
5. Fratres Platform and Services
Fratres is a digital employment and recruitment platform that provides a marketplace and set of tools to facilitate connections between job seekers and employers or recruiters.
The Services provided by Fratres may include, but are not limited to:
- Hosting and displaying job listings submitted by employers and recruiters;
- Enabling candidates to create professional profiles and upload CVs or resumes;
- Providing candidate search and filtering tools for employers and recruiters;
- Facilitating job applications and candidate–employer communications;
- Providing job alerts, notifications, and recommendation features;
- Offering employer branding and recruitment-related tools;
- Delivering country-specific and global job discovery features; and
- Providing any other recruitment-related features made available through the Platform from time to time.
Fratres acts solely as an intermediary platform. We do not act as an employer, staffing agency, employment agency, or recruitment agency in respect of any user. We do not hire, employ, or place candidates. We do not guarantee the accuracy, completeness, or legality of any job listing or employer. We do not guarantee that any candidate, employer, or recruiter will achieve any particular outcome through use of the Platform.
6. User Accounts and Account Security
6.1 Account Registration
To access certain features of the Platform, you may be required to register for an account. When registering, you agree to provide accurate, current, and complete information and to keep that information up to date.
6.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your login credentials;
- All activity that occurs under your account;
- Immediately notifying Fratres if you become aware of any unauthorised access to or use of your account; and
- Ensuring that you log out at the end of each session on shared or public devices.
Fratres will not be liable for any loss or damage arising from unauthorised access to your account that results from your failure to maintain adequate account security.
6.3 Account Accuracy
You must not impersonate any person or entity, misrepresent your identity or affiliation, or provide false or misleading information when registering for or using an account.
6.4 Account Restrictions
Accounts are personal and non-transferable unless expressly permitted by Fratres. You may not create multiple accounts to circumvent restrictions or for abusive purposes.
7. Candidate and Job Seeker Responsibilities
As a candidate or job seeker using the Platform, you agree to:
- Provide accurate, truthful, and complete information in your profile, CV, resume, and job applications;
- Keep your profile and application information current and updated;
- Use the Platform solely to search for genuine employment opportunities;
- Respond honestly and professionally to communications from employers and recruiters;
- Not submit applications to positions for which you are not genuinely interested or qualified, where doing so would be misleading or wasteful of employer resources;
- Comply with all applicable laws in connection with your job search, applications, and employment activities;
- Not upload content that is false, fraudulent, defamatory, discriminatory, or otherwise inappropriate; and
- Take full responsibility for the accuracy and authenticity of all information you submit.
Fratres does not verify the accuracy of candidate profiles, CVs, or application information. Candidates are solely responsible for ensuring the truth and accuracy of all information they provide.
8. Employer and Recruiter Responsibilities
As an employer or recruiter using the Platform, you agree to:
- Provide accurate, complete, and lawful information in all job listings and employer profiles;
- Ensure that job listings comply with all applicable employment laws, anti-discrimination laws, and regulations in all jurisdictions where the role is advertised;
- Not post misleading, fraudulent, or deceptive job listings;
- Use candidate information solely for lawful recruitment and hiring purposes;
- Handle candidate personal data in compliance with applicable data protection and privacy laws;
- Conduct recruitment processes in a fair, professional, and non-discriminatory manner;
- Be solely responsible for all hiring decisions, employment offers, and recruitment outcomes;
- Not use the Platform to harvest candidate data for purposes unrelated to legitimate recruitment; and
- Comply with all applicable laws in connection with your use of the Platform.
Fratres does not endorse any employer or recruiter and is not responsible for the conduct, practices, or decisions of employers or recruiters using the Platform.
9. Job Listings and Recruitment Content
9.1 Employer Responsibility for Listings
All job listings on the Platform are submitted by employers or recruiters. Fratres does not create, author, or endorse any job listing. Employers and recruiters are solely responsible for the content, accuracy, legality, and appropriateness of their job listings.
9.2 Platform Review Rights
Fratres reserves the right, but does not assume any obligation, to review, screen, monitor, refuse, remove, or modify any job listing or other content at any time and for any reason, including where we believe the content violates these Terms or applicable law.
9.3 No Employment Relationship
The posting of a job listing on the Platform does not create any employment relationship between Fratres and any candidate, employer, or recruiter.
9.4 Listing Accuracy
Fratres does not warrant or guarantee the accuracy, completeness, quality, or suitability of any job listing. Users are advised to independently verify the details of any job listing before applying or making hiring decisions.
10. User-Generated Content
10.1 Your Content
By submitting any User Content to the Platform, you grant Fratres a non-exclusive, worldwide, royalty-free, sublicensable licence to use, store, display, reproduce, modify, and distribute your User Content to the extent necessary to operate and provide the Platform and Services.
10.2 Your Responsibility
You are solely responsible for all User Content you submit. You represent and warrant that:
- You own or have the necessary rights to submit the User Content;
- Your User Content does not infringe any third-party intellectual property rights;
- Your User Content is accurate and not misleading; and
- Your User Content complies with these Terms and all applicable laws.
10.3 Prohibited Content
You must not submit User Content that is unlawful, defamatory, harassing, abusive, fraudulent, discriminatory, obscene, or otherwise objectionable.
11. Accuracy and Authenticity of Information
All users are responsible for the accuracy of the information they provide on the Platform. Fratres does not independently verify:
- The identity of users;
- The qualifications, credentials, or experience of candidates;
- The legitimacy, existence, or practices of employers or recruiters;
- The accuracy of job listings, salary information, or role descriptions; or
- The accuracy of any other User Content.
Users rely on information provided by other users at their own risk. Fratres strongly encourages all users to exercise appropriate due diligence before making employment or hiring decisions.
12. Prohibited Activities
You agree not to use the Platform for any of the following purposes or in any of the following ways:
- Posting, submitting, or transmitting fraudulent, false, misleading, or deceptive content;
- Impersonating any person, entity, company, or organisation;
- Collecting or harvesting personal data of other users without authorisation;
- Using the Platform to send spam, unsolicited communications, or bulk messages;
- Engaging in discriminatory practices in recruitment or hiring based on characteristics protected by applicable law;
- Posting job listings that are not genuine employment opportunities, or that are designed to collect personal information under false pretences;
- Reverse engineering, copying, or attempting to extract source code or proprietary components of the Platform;
- Using automated tools, bots, scrapers, or crawlers to access, collect, or extract data from the Platform without express written permission;
- Introducing viruses, malware, or other harmful code to the Platform;
- Attempting to gain unauthorised access to any part of the Platform, other users' accounts, or Fratres systems;
- Using the Platform in any manner that could disable, damage, or impair its functionality;
- Using the Platform to facilitate illegal activity, including but not limited to labour trafficking, exploitation, or unlawful recruitment practices;
- Violating any applicable local, national, or international law or regulation; or
- Encouraging or facilitating any of the above activities.
13. Platform Usage Rules
Users must use the Platform responsibly and in good faith. You agree to:
- Use the Platform only for its intended purpose of facilitating employment and recruitment connections;
- Treat other users, employers, candidates, and recruiters with respect and professionalism;
- Not abuse Platform messaging features or contact other users for purposes unrelated to recruitment;
- Not circumvent any access restrictions, account verification measures, or security features; and
- Report suspected fraudulent, abusive, or illegal activity to Fratres promptly.
14. Intellectual Property Rights
14.1 Fratres Intellectual Property
All intellectual property on the Platform, including but not limited to the Fratres name, logo, brand elements, design, software, technology, databases, and content created by Fratres, is owned by or licensed to Fratres and is protected by applicable intellectual property laws worldwide.
Nothing in these Terms grants you any ownership of or licence to use Fratres intellectual property, other than the limited right to access and use the Platform for its intended purposes.
14.2 Restrictions
You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, or otherwise exploit any Fratres intellectual property without our prior written consent.
14.3 User Content Ownership
You retain ownership of your User Content, subject to the licence granted to Fratres in Section 10.1.
15. Third-Party Content and Services
The Platform may contain links to, or integrate with, third-party websites, services, or resources. These third-party resources are not under Fratres' control, and Fratres is not responsible for their content, accuracy, availability, or practices.
Links to third-party resources are provided for your convenience and do not constitute endorsement by Fratres. Your use of any third-party service is subject to that service's own terms and privacy policy.
16. Communications and Notifications
By registering an account on the Platform, you agree to receive:
- Transactional communications necessary for the operation of your account and the Platform (such as registration confirmations, application updates, and account-related notifications); and
- Communications related to your use of the Platform as described in our Privacy Policy.
You may manage your communication preferences through your account settings. For marketing communications, we will seek your consent where required by applicable law. Please refer to our Privacy Policy for further information.
17. Employment and Recruitment Disclaimer
Fratres is a technology platform that facilitates connections between job seekers and employers or recruiters. Fratres is not an employer, staffing agency, or recruiter.
Fratres does not:
- Make or participate in hiring decisions;
- Negotiate employment terms or conditions on behalf of any party;
- Represent any employer, recruiter, or candidate;
- Guarantee the quality, legitimacy, or appropriateness of any job listing or candidate profile; or
- Mediate or arbitrate disputes between candidates and employers.
All employment decisions, offers, contracts, and related matters are the sole responsibility of the relevant employers, recruiters, and candidates.
18. No Guarantee of Employment or Hiring
Fratres makes no guarantee, representation, or warranty that:
- Any candidate will obtain an interview, job offer, or employment through the Platform;
- Any employer or recruiter will find suitable candidates through the Platform;
- Any job listing will remain available, accurate, or result in a hire;
- Any salary, benefit, or working condition described in a job listing will be honoured;
- Any visa, work permit, or immigration approval will be granted in connection with any opportunity on the Platform; or
- Any particular outcome will result from use of the Platform.
Use of the Platform does not guarantee any employment or recruitment result. Users are encouraged to use the Platform as one of multiple tools in their employment or recruitment activities.
19. Platform Availability and Service Changes
Fratres aims to provide a reliable and accessible Platform. However, we do not guarantee that the Platform will be available at all times, free from interruptions, errors, or defects.
Fratres reserves the right to:
- Modify, suspend, or discontinue any part of the Platform or Services at any time;
- Introduce new features, tools, or services;
- Restrict access to certain features or services; and
- Perform maintenance, upgrades, or updates that may temporarily affect availability.
We will endeavour to provide reasonable notice of material changes or planned downtime where practicable, but we are not obligated to do so in all circumstances.
20. Suspension and Termination
20.1 By Fratres
Fratres reserves the right to suspend or terminate your access to the Platform, or to remove any content you have submitted, at any time and without prior notice if we believe you have violated these Terms, applicable law, or have engaged in conduct that is harmful to other users, Fratres, or third parties.
20.2 By You
You may close your account and cease using the Platform at any time. Closing your account does not automatically result in the deletion of all your data. Please refer to our Privacy Policy for information on how to request data deletion.
20.3 Effect of Termination
Upon termination of your account, your right to access and use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall continue to apply, including Sections 10, 14, 21, 22, 23, and 24.
21. Privacy and Personal Data
Your privacy is important to us. Our Privacy Policy explains how we collect, use, share, and protect your personal information when you use the Platform. The Privacy Policy forms part of these Terms and is incorporated by reference.
By using the Platform, you acknowledge that you have read and understood our Privacy Policy.
22. Limitation of Liability
To the fullest extent permitted by applicable law:
- Fratres shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use of, or inability to use, the Platform;
- Fratres shall not be liable for any loss of employment opportunity, income, profit, data, goodwill, or business arising from use of the Platform;
- Fratres shall not be liable for the conduct, actions, or omissions of any employer, recruiter, candidate, or other third party; and
- Fratres' total aggregate liability to you for any claim arising out of or relating to these Terms or your use of the Platform shall not exceed the amount paid by you (if any) to Fratres in the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms shall limit or exclude liability that cannot be excluded under applicable law.
23. Indemnification
You agree to indemnify, defend, and hold harmless Fratres, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Your use of or access to the Platform;
- Your User Content;
- Your violation of these Terms; or
- Your violation of any applicable law or the rights of any third party.
24. Disclaimers
The Platform and all Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement;
- Warranties regarding the accuracy, completeness, reliability, or suitability of any content on the Platform;
- Warranties that the Platform will be uninterrupted, error-free, or free from harmful components; or
- Warranties that any employment or recruitment outcome will result from use of the Platform.
Some jurisdictions do not allow the exclusion of certain warranties. If applicable law requires any warranty, Fratres' liability shall be limited to the minimum extent permitted by law.
25. Changes to the Terms
Fratres reserves the right to modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this page and, where practicable, notify users through the Platform or by other appropriate means.
Your continued use of the Platform after updated Terms have been published constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should discontinue use of the Platform.
26. Applicable Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with principles that apply to international commercial relationships, taking into account the global nature of the Fratres Platform.
Fratres operates across multiple countries and jurisdictions. Users are responsible for compliance with the laws applicable in their own jurisdictions. Nothing in these Terms overrides any mandatory legal rights or protections to which a user may be entitled under the laws of their own country.
In the event of any dispute arising from or relating to these Terms or the Platform, we encourage users to contact Fratres in the first instance to seek an amicable resolution. Applicable mandatory consumer protection or dispute resolution frameworks in your jurisdiction may also apply.
27. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable under applicable law, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
28. Entire Agreement
These Terms, together with the Privacy Policy and any other policies or guidelines published by Fratres on the Platform, constitute the entire agreement between you and Fratres regarding your use of the Platform and supersede all prior agreements, representations, or understandings relating to the same subject matter.
